MBF BAIL REFERRAL APPLICATION

1. My client has no active warrants which would prevent them from being released if the Massachusetts Bail Fund posts their bail. If my client does have hold/s that would prevent them from being released, I have included an explanation on the form and/or have spoken to a Bail Fund representative about this issue.

2. I have spoken to my client about potentially receiving assistance from the Massachusetts Bail Fund, and my client gives their permission for me to share their history and case information with the Massachusetts Bail Fund.

3. My client does not have any known ICE detainers. If they do, I will make sure to include all pertinent information in the application including the nature of the detainer and concerns about ICE interactions upon release from jail.

IMPORTANT: If your client has an ICE detainer this SHOULD result in their release once bail is posted under the Lunn v. Commonwealth decision which can be found at aclum.org/wp-content/uploads/2017/04/20170724-Lunn-SJC-opinion.pdf.

HOWEVER - we have posted bail at Middleton HOC, Nashua Street Jail & Billerica House of Corrections where we have been told that the jail will call ICE to pick up people. Please submit a complete referral for any client who is held on an ICE detainer and please include any knowledge about their immigration status within the referral so MBF may assist in the best way possible.

The Massachusetts Bail Fund posts bail in Middlesex, Essex, Suffolk, Worcester & Hampden Counties.
