MBF BAIL REFERRAL APPLICATION

IMPORTANT: If your client has an ICE detainer, law enforcement cannot hold your client for ICE once bail is posted under the Lunn v. Commonwealth decision which can be found at aclum.org/wp-content/uploads/2017/04/20170724-Lunn-SJC-opinion.pdf.  

HOWEVER - we have posted bail at Middleton HOC, Nashua Street Jail & Billerica House of Corrections where we have been told that the jail will “hold” someone for ICE. Please submit a complete referral for any client who is held on an ICE detainer and please include any knowledge about their immigration status within the referral so MBF may assist in the best way possible.
